Personal Requirements

 

Each participant undertakes to meet the mental and physical requirements necessary for the selected tour, as set out in the catalogue, the detailed itinerary and the terms and conditions. Persons under the influence of medication, alcohol or drugs are excluded from the tour.

 

Safety/Risk

 

Every participant on tours organised by Freelife Outdoorsport is aware that they are taking part in an adventure activity which cannot offer the comfort and safety of a standard package holiday. Tours organised by Sportagentur Strobl GmbH are led by qualified tour guides. The equipment complies with the latest safety standards. All tours are carefully planned and prepared. Before each tour, the tour leader provides a comprehensive briefing. However, the risks are varied and cannot therefore be entirely ruled out. Liability for all damages and claims against Freelife Outdoorsport and the tour leaders, regardless of the legal basis, is limited to gross negligence and wilful misconduct. The organiser is not liable for damages resulting from activities that go beyond the booked programme. The person booking the tour expressly confirms that they have submitted the booking on behalf of and with the authorisation of the registered participants. Mountain rescue costs (emergency medical helicopters, mountain rescue services, etc.) must be borne by the participant requiring rescue, unless these are covered by Freelife Outdoorsport’s existing liability insurance.

 

Cancellation of the tour/exclusion of participants

 

The tour leader is entitled to exclude guests from the tour or to cancel the tour if they breach our terms and conditions, in particular if they do not meet the requirements necessary for the tour. The tour leader reserves the right to amend, extend or restrict the tour programme due to unforeseen circumstances that may endanger the safety of guests (for example, excessively high water levels, sudden changes in weather, or participants’ insufficient skills). The organiser is entitled to withdraw from the contract should such circumstances arise.

Injuries and damage must be reported to the tour leader immediately.

 

Tour duration

 

It is not always possible to determine the exact duration of a tour in advance. The times stated in the brochure/on the website are for guidance only.

 

Liability

 

In some cases, travel to and from the tour destinations is by private motor vehicle. Such journeys are not part of our programme. We therefore accept no liability whatsoever for accidents or damage arising therefrom.

The organiser is liable for services provided by third parties only in respect of their proper arrangement, e.g. accommodation, meals and transfers. Participation in all events is at your own risk. If equipment is hired, the hirer is responsible for ensuring it is returned in good order.

Most of the tours and trips on offer are of a sporting and adventurous nature and therefore place increased demands on fitness and health. The tour guides’ instructions must be followed at all times.

 

Special conditions for rafting tours

 

Participation requires adequate swimming ability in flowing water. During the trip, passengers must ensure that the chin straps of their helmets and the fastenings of their life jackets are securely fastened. Each participant must ensure that they carry the equipment required for the tour. The tour leader has the right to exclude a participant from the tour if their equipment is incomplete – provided this is due to the participant’s negligence. Smoking and making noise during the trip are prohibited.

Passengers are liable for any wilful damage to boats and equipment.

Passengers are obliged to assist with loading and unloading the boat onto and off the transport vehicle.

It is the passenger’s own responsibility to exercise particular caution when getting into and out of the boat, as shallow waters, slippery rocks, varying current conditions and the movement of the boat are to be expected, all of which pose an increased risk of injury.

 

Special Terms and Conditions for Canyoning Tours

 

Canyon trekking takes place largely in terrain without defined paths, where particularly slippery sections are to be expected. Participants must therefore be prepared for the possibility of slipping at any time. Consequently, every participant must move with particular care and caution. The tour leader will demonstrate how to move safely. Any areas where there is a risk of falling may only be traversed when secured and under the supervision of the canyoning guide. There is a risk of falling rocks in a canyon.

Each participant must ensure that they maintain visual contact with the other participants and the canyoning guide at all times.

Special equipment is used on a canyoning tour. Each participant will receive detailed instruction on how to use this equipment both before and throughout the tour. This equipment must be handled with particular care and caution.

Jumping is only permitted with the express permission of the canyoning guide, and instructions must be followed precisely. In the pools, varying water depths are to be expected; therefore, participants must only jump into the area designated by the canyoning guide. Should a participant feel unable to do so based on their own assessment, they must inform the canyoning guide, who is obliged to find alternative ways to safely negotiate the difference in height. Each participant must ensure that they choose a safe, non-slip jumping point, keep their hands close to their body during the jump, and jump feet first only. It must generally be expected that the feet will touch the ground, which is why the jump must be broken with the legs. Sliding along the riverbed must be carried out in a reclined position, with the head tilted forwards and hands clasped together. Each participant must bring their own ankle-high shoes with non-slip soles, suitable for walking on rough terrain.

Every guest must ensure that their harness, helmet and carabiner are always securely fastened. Any irregularities must be reported to the canyoning guide immediately. Each participant must show consideration for other participants and, at the canyoning guide’s instruction, provide reasonable assistance.

 

Photos and videos

 

Many guests would like photos of the tours, which we are happy to take where possible. We also take photos and videos for promotional purposes (website, Facebook, etc.). By booking our tours, you personally agree that we may use photos of groups in which you were a member for these purposes. We undertake to use only photos that are neither indecent nor infringe upon the guest’s privacy.

Liability

The organiser is liable for services provided by third parties only in respect of their proper arrangement, e.g. accommodation, meals and transfers. Participation in all events is at your own risk. If equipment is hired, the hirer is liable for its proper return. The organiser holds public liability insurance which covers all programmes.

Cancellation due to force majeure

If the trip is significantly impeded, endangered or compromised as a result of force majeure that could not have been foreseen at the time the contract was concluded, or if the safety of customers can no longer be guaranteed, then, following consideration of a possible postponement or the proposal of an equivalent alternative programme, both you and we may terminate the contract. In the event of cancellation before the start of the trip for the aforementioned reasons, you will be refunded the travel price paid. No further claims shall arise. Should the aforementioned reasons arise after the start of the trip, the travel contract may be terminated by either party following consideration of a possible postponement or an equivalent alternative programme. If the contract is terminated, we may claim reasonable compensation for travel services already provided or still to be provided to complete the trip. Paid tours will be refunded in the event of cancellation; vouchers retain their validity.

 

Booking

 

Upon receipt of our booking confirmation (usually by email), the travel contract becomes binding on both parties and these terms and conditions of travel are deemed to have been accepted. The person making the booking expressly confirms that they are submitting the travel booking on behalf of, and with the authorisation of, all the travellers listed in the booking (group bookings).

Non-utilisation of services
If, for whatever reason, a participant does not make use of travel services, no refund will be made.

Prices
All prices include the currently applicable VAT rates. All prices are quoted per person, unless otherwise stated.

Withdrawal, Cancellations and Failure to Commence Trips and Booked Programmes

In the event of withdrawal, the following cancellation fees will be charged regardless of the reason for withdrawal: up to 30 days before the start of the trip: 10% of the total trip price; from 29 to 15 days before: 30%; from 14 to 3 days before: 50%; from the 2nd day onwards or in the event of non-attendance: 100%. We recommend taking out travel cancellation insurance (Europäische Reiseversicherung).

For certain courses and events, a minimum number of participants (4 people) applies, as stated in the relevant course description. If this minimum number of participants is not reached, the organiser reserves the right to cancel the course no later than 3 calendar days before the start of the course or tour, or to offer an alternative date. In this case, any participation fees already paid will be refunded in full or – at the participant’s request – credited towards an alternative date. No further claims, in particular for compensation for travel, accommodation, loss of earnings or other consequential costs, shall arise – to the extent permitted by law

 

Language

 

The standard language for contracts, orders and business dealings is German. For translations into languages other than German, an automated, software-based translation system (provided by Google) is used on the website. The customer acknowledges that automatic translation systems are not 100% error-free and that translation results may be inaccurate. rafting.at/Sportagentur Strobl cannot be held liable for any misunderstandings arising from inaccurate translation results in languages other than German.

 

Place of jurisdiction

 

The place of jurisdiction for both parties is the location where the travel services were provided or our registered office.
